Amend the regulations on the origin of goods on the label of goods

 

The Government of Vietnam promulgated Protocol No. 111/2021/ND-CP, supplementing and amending the regulations on product labelling in Protocol No. 43/2017/ND-CP, supplementing and amending Article 15 of Protocol No. 111/2021/ND-CP the origin of the goods.

 

Specifically, the organization/natural person producing, exporting and importing shall determine and indicate the origin of the goods on their own to ensure fidelity and correctness, and comply with the relevant laws and regulations on the origin of goods in Vietnam (including goods for import, export and domestic production in Vietnam), or comply with international commitments to which Vietnam is a member. (Additional organization/natural person to export goods with the current regulations).

 

Use "produced in", "manufactured in", "country of production", "place of origin", "produced by", "product of..." on the label, plus the name of the country/region of production, or indicate in accordance with the relevant regulations of the place of origin of the goods.

 

If the origin of the goods cannot be confirmed in accordance with the above provisions, the final manufacturing process location of the goods shall be used to indicate. Use "Assembled in", "Canned in", "Incorporated in", "Finished in", "Packed in", "Labeled in" plus the name of the country/region where the final process is performed.

 

The name of the country in which the goods are produced or the country in which the goods are finalized cannot be abbreviated.

 

In addition, No. 111/2021/ND-CP agreed to supplement and amend Article 12 Item 3 - Name and address of the organization/natural person responsible for the goods. Specifically, imported goods sold in Vietnam are marked with the name and address of the manufacturer and importer/natural person on the label.

 

If the goods are domestically produced or imported medical equipment, the name and address of the owner and the name and address of the owner of the free sales registration number shall be indicated. If the medical device does not have a free sale registration number, the import license shall indicate the name and address of its owner.

 

Agreement No. 111/2021/ND-CP entered into force on 15 February this year.

 

Suspension of temporary import and export of medical masks, medical gloves and anti-pandemic clothing

 

On January 28, the Ministry of Industry and Commerce of Vietnam issued Announcement No. 03/2022/TT-BCT on the business model of temporarily suspending the import and export of medical masks, medical gloves and anti-pandemic clothing.

 

Consignments that have gone through customs formalities between January 1 and March 15 can still be re-exported in accordance with the provisions of the agreement No. 69/2018/ND-CP.

 

The products involved are listed in the appendix to the above announcement.

 

Specifically:

- Chapter 39: Tariff No. 3926.20.90 (Medical Gloves)

- Chapter 40:

+ Tariff number column 4015.11.00 (medical gloves)

+ Tariff number column 4015.19.10 (medical gloves)

- Chapter 62: Tariff No. 6210.10.90 (anti-pandemic clothing includes: anti-pandemic clothing, face shields, masks, hats, gloves, shoes)

- Chapter 63:

+ Tariff number column 6307.90.40 (medical masks)

+ Tariff number column 6307.90.90 (medical masks)

 

Announcement No. 03/2022/TT-BCT is valid from March 15 to December 31 this year.

 

Temporary import and re-export means that Vietnamese businessmen purchase goods from abroad, go through import formalities in Vietnam and export the goods outside Vietnam.

 

Argentina

 

Preliminary anti-dumping ruling on metal protective grilles for electric fans

 

On February 4, 2022, the Ministry of Production and Development of Argentina issued Announcement No. 42 of 2022 in Argentina's "Official Gazette", regarding the metal protective grilles for electric fans (Spanish: Rejillas metálicas de protección) originating in mainland China and Taiwan. , de diámetro superior a 400mm, de los tipos utilizados en ventiladores con motor eléctrico incorporado) made a preliminary anti-dumping ruling and decided to impose provisional anti-dumping duties:

 

A 73% ad valorem tax is levied on the involved products originating in mainland China, and a 25% ad valorem tax is levied on the involved products originating in Taiwan, China. The product involved is a metal protective grille with a diameter of more than 400 mm, which is used for fans with built-in motors, and the customs code of the Mercosur is 8414.90.20. The announcement takes effect from the date of publication and is valid for six months.
